Introduction

FlashParking, Inc., together with its subsidiaries and affiliates (“Company,” “We” or “Us”) respects your privacy and is committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide to us through services accessible via www.FlashParking.com, www.ParkWhiz.com, or any other website, IP address, social media account, iOS app, Android app, web app or other online product and service offered by FlashParking including but not limited to ParkWhiz and BestParking (collectively, the “Service”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect through the Service and in email, text, and other electronic messages between you and the Service. It does not apply to information collected by us offline or through any other means, including on any other website operated by us or any third party or by any third party that may link to or be accessible from or on the Service.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, do not use the Service. By accessing or using the Service, you agree to the terms of this privacy policy. This policy may change from time to time as described below. Your continued use of the Service after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

1. Information We Collect

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information“).

Consumers: In particular, we have collected the following categories of personal information from our consumers within the last twelve (12) months:

F. Vehicle data License plate number and state and details about vehicles including make, model, color and year.
G. Account Information Such as username, password, and security questions that you select and the answers you provide. We use this information to provide the Services and to maintain and secure your account with us. If you choose to register an account, you are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.
H. Payment Information A 3rd party payment processor collects this information directly (but on our behalf) and we use this information to process your payment to provide the Services.
I. Any other information you choose to provide to us Any other information provided by you in communications to us, such as though our online help chatbots, or by sending a message through our web or mobile app help desk.
J. Analytics data Analytics data we receive from analytics providers such as Google Analytics.


Employees and/or Contractors:
In particular, we have collected the following categories of personal information from our employees and contractors within the last twelve (12) months:

Protected classification characteristics Age, race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability or sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions).
D. Location data Physical location.
E. Data regarding vehicles License plate number and state and details about vehicles including make, model, color and year.


We collect this information:

  • Directly from you when you otherwise provide it to us.
  • Automatically as you navigate through our website or use the App (as defined below), which information may include usage details, IP addresses, and other information collected through cookies, web beacons, and other tracking technologies described in the Section titled “Information We Collect Through Automatic Data Collection Technologies” below;
  • When you purchase, order, return, exchange or request information about our products and services;
  • When you participate in any interactive features of the Service;
  • When you sign up for our e-mails, mobile messages, or social media notifications as described in the section titled “Information We Collect Through Social Media” below;
  • When you enter a contest or sweepstakes, respond to one of our surveys, or participate in a focus group as described in more detail under the section titled “Information We Collect Through Surveys and Polls” below;
  • When you provide us with comments, suggestions, or other input; and,
  • When you submit an application for employment with us.


Cookies, GPC Signal and Other Automatic Data Collection Technologies 

As you navigate through and interact with our website, we may use cookies and other automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including: 1) details of your visits to the website, such as traffic data, location data, logs, and other communication data and the resources that you access and use; and 2) Information about your computer and internet connection, including your IP address, operating system, and browser type.

Our website recognizes the Global Privacy Control (GPC) signal, which enables you to opt-out of certain uses or disclosures of your information. If you notify us of your preference through GPC, we will honor your request only for the browser or device that sends the GPC signal.

The information we collect automatically helps us to improve the Service and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns;
  • Store information about your preferences;
  • Speed up your searches; and
  • Recognize you when you return to our website.


Information We Collect Through Our App

To enable our push notification and other mobile communication services, we may collect and store device IDs to identify each unique mobile device that registers for our service, including for example, device tokens from iOS devices, Live IDs from Windows devices, and other similar identifications from devices running on other platforms. These IDs cannot be tracked back to you, but are tied to a specific device which may only be used by one person. We may collect information including location-related information, internet protocol addresses, mobile device models, carrier information, the operating system of your mobile devices and other non-personally identifiable information.

Information You Provide to Us 

If you contact us on or through the Service or to apply for employment with us, the information we collect may include personal information such as name, e-mail address, telephone number, and any other information you provide to us, including records and copies of your correspondence.

2. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information, to:

  • Fulfill or meet the reason you provided the information. For example, if you share your name and contact information to request a price quote or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and facilitate delivery. We may also save your information to facilitate new product orders or process returns;
  • Fulfill and manage purchases, orders, payments, returns, exchanges and requests for information;
  • Provide, support, personalize, and develop our website, products, and services;
  • Create, maintain, customize, and secure your account with us;
  • Enroll you in our trusted driver network to ensure smooth and friction-free future parking transactions with us and our affiliated parking business partners;
  • Send marketing communications and other information regarding products, services and promotions;
  • Send communications via SMS message, App notification, email or otherwise regarding the Services;
  • Improve the effectiveness of the Service, website, stores, mobile experience and marketing efforts;
  • Conduct research and analysis, including focus groups and surveys;
  • Process your requests, purchases, transactions, and payments and prevent transactional fraud;
  • Respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; and
  • For any other purpose with your consent.

In addition to the specific uses described above, we may use any of the above information to provide you with the Services and to maintain our business relationship, including by enhancing the safety and security of our Services (e.g., troubleshooting, data analysis, testing, system maintenance, and reporting), providing customer support, sending service and other non-marketing communications, monitoring and analyzing trends, conducting internal research and development, complying with applicable legal obligations, enforcing any applicable terms of service, and protecting the Services, our rights, and the rights of our employees, users or other individuals.

We may combine the information that we collect through the Service with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Privacy Policy. Your browsing activity may be tracked across different websites and different devices or apps. For example, we may attempt to match your browsing activity on your mobile device with your browsing activity on your laptop. To do this, our technology partners may share data, such as your browsing patterns, location and device identifiers, and will match the information of the browser and devices that appear to be used by the same person.

In addition, we use the User-ID feature of Google Analytics to help us enhance your user experience. User-ID lets us associate a persistent ID for you with your engagement data from one or more sessions initiated from one or more devices. This ability to connect your contacts with us into a single thread also provides us with a more unified, holistic story about your relationship with our business. We will use information received through our use of User-ID in the manner described above. If you would like to opt-out of our use of this service, you may do so by following the instructions found under “Updating Personal Information” below.

Finally, we may deidentify or anonymize your information such that it cannot reasonably be used to infer information about you or otherwise be linked to you (“deidentified information”) (or we may collect information that has already been deidentified / anonymized), and we may use such deidentified information for any purpose. To the extent we possess or process any deidentified information, we will maintain and use such information in deidentified/anonymized form and not attempt to re-identify the information, except solely for the purpose of determining whether our deidentification/anonymization process satisfies legal requirements.

3. Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To fulfill the purpose for which you provide it;
  • To our subsidiaries and affiliates, in which case we will require our subsidiaries and affiliates to honor this privacy policy;
  • To third-party service providers who perform services on our behalf and help us provide the Services, including for system administration, cloud storage, security, customer relationship management, marketing communications, web analytics, payment networks, and payment processing;
  • To business partners with whom we jointly offer products or services, including when you utilize our Service through a partner’s application or service;
  • With certain business partners to provide requested services that we do not provide directly;
  • To our customers, including but not limited to owners and operators of parking locations and their service providers, for their legitimate business purposes, including in order to facilitate your access to parking locations or such customer’s services and/or for security and enforcement purposes;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about the Service users is among the assets transferred;
  • Professional advisors, such as auditors, law firms or accounting firms; and,
  • With your consent:

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request;
  • To enforce or apply our terms of use agreement; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of us, our customers or others.

In the preceding twelve (12) months, we have not sold personal information and have only disclosed it, as necessary, in accordance with the terms of this privacy policy.

4. Privacy of Mobile Applications

With respect to your use of the mobile application portion of our Service (the “App”), the App may collect certain information automatically, such as the type of mobile device you use, the temporary or persistent unique device identifiers (sometimes called UDID) placed by us or our service providers, the unique identifier assigned by us to your device, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the App.

Additionally, the App collects precise information about the location of your device. You must first provide permission through your device before our App obtains such location information from technologies like GPS, Wi-Fi, or cell tower proximity (or a combination of these technologies). We, and our service providers, may use and store this information, in combination with other location-based information such as the IP address and billing or postal code provided by you at time of your App registration, to provide enhanced location-based services, such as site-specific services, search results, and other content. You can stop all collection of information by the App easily by uninstalling the App. Also, you may at any time opt-out from further allowing us to have access to your location data by adjusting the permissions in your mobile device.

5. Our Use of Tracking Technologies

The technologies we use for this automatic data collection may include:

Cookies (or browser cookies):

A cookie is a small file placed on the hard drive of your computer. When you use the Service, we may place one or more cookies in your browser. These are required to enable us to hold session information as you navigate from page to page within the Service. In addition, we use cookies through the Service to understand visitor and user preferences, improve their experience, and track and analyze usage, navigational and other statistical information.

  • We use both strictly necessary and optional cookies. Strictly necessary cookies are essential for the functioning of the webpage and may not be declined. You may decline optional cookies though the cookie banner on our website homepage. If you choose to decline cookies, this could affect certain features of our Service.


Web Beacons:

Pages of the Service may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

6. Our Retention of Your Information

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

7. Our Protection of Your Information

We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from the Service is at your own risk. You should only access the Service within a secure environment.

8. Children

Children under the age of 13 are not permitted to use the Services, and we do not seek or knowingly collect any personal information about children under 13 years of age. If we become aware that we have unknowingly collected information about a child under 13 years of age, we will make commercially reasonable efforts to delete such information. If you are the parent or guardian of a child under 13 years of age who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

9. Notices for California Residents

This section applies to applies to all visitors, users, and others who reside in the State of California and is adopted to comply with laws governing residents of the State of California, including the CCPA. This Section does not apply to employment-related personal information collected from California-based employees, job applicants, contractors, or similar individuals.

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

A. Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights below), we will disclose to you:

  • The categories of personal information we collected about you;
  • The categories of sources for the personal information we collected about you;
  • Our business or commercial purpose for collecting or selling that personal information;
  • The categories of third parties with whom we share that personal information;
  • The specific pieces of personal information we collected about you (also called a data portability request).

If we sold or disclosed your personal information for a business purpose, we will disclose to you two separate lists, consisting of:

  • sales, identifying the personal information categories that each category of recipient purchased; and
  • disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.


B. Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights below), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you;
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.);
  • Debug products to identify and repair errors that impair existing intended functionality;
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research, and if you previously provided informed consent;
  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.


C. Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

  • Write us at the address provided below; or
  • Sending us an email at the address provided below.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To designate an authorized agent please e-mail us at the email address provided below and provide your name and phone number as well as the authorized agents’ name and contact information (phone number or email address) and let us know what the scope of the authorized agents’ rights are to act on your behalf. If your authorized agent requests sensitive information about you then we may ask you to provide us with a sworn declaration to further verify your identity.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include your full name, email address, phone number and zip code.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

D. Response Timing and Format

We attempt to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 45 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or unreasonable. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

E. Personal Information Sales Opt-Out Rights

Flash does not sell your personal information and has not sold any personal information in the proceeding 12 months, as such terms are defined under the CCPA. Flash shares your personal information in accordance with this policy. If you wish to opt out of the sharing of your information please submit your request by clicking on the “Do Not Sell or Share My Personal Information” button at the bottom of our webpage.

F. Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.


G. “Shine the Light” Law

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

H. Automated License Plate Recognition Law

California Civil Code Section 1798.90.51, titled “Collection of License Plate Information,” requires automated license plate recognition (“ALPR”) providers implement a usage and privacy policy with respect to the collection, use, maintenance, sharing, and dissemination of ALPR information. Although we primarily sell equipment or offer services with respect to ALPR systems, the following information is presented in the event, and to the extent, we operate an ALPR system in California:

The purpose for using the ALPR system and collecting ALPR information.

We may use an ALPR system in connection with our Services to track ingress and egress of vehicles into and out of properties that use our Services.

Access to the ALPR System:

We engage third-party independent contractors to install and maintain ALPR systems for our clients. Our Chief Technology Officer and the technology/product team reporting to them may, under certain circumstances, be able to access ALPR information. The parking operators in properties that contract our Services also have access to the ALPR system.

Monitoring for Security and Compliance with Applicable Privacy Laws:

We have taken all reasonable steps to safeguard the information technology systems utilized in the operation of our business, including the implementation of procedures to ensure that our systems are free from any disabling codes or other software routines or hardware components that would permit unauthorized access by a third party.

Restrictions on the Sale, Sharing or Transfer of ALPR Data:

ALPR information in our possession may be shared in accordance with this policy with our parking owners and operator customers for parking transactional purposes and to provide consumer motorists with the parking product or service requested. ALPR information may be shared with third party vendors of our customers in accordance with this policy and a Data Protection Agreement. In states where collection is permitted for unpaid parking citations, we may also share parking violation information with a third party collection agency.

Responsible Personnel:

Our Chief Technology Officer and the technology/product team reporting to them are responsible for the oversight and implementation of our ALPR compliance.

Information regarding ALPR Information accuracy and corrections:

Flash can review ALPR information captured by ALPR systems for accuracy. When requested by the end user to verify ALPR information in our possession, we will take reasonable measures to do so and to confirm such information and, if inaccurate, correct such information.

Retention of ALPR Information

ALPR information will be retained in accordance with our Privacy Policy and as long as required to verify the legitimacy of charges incurred in our facilities per parking operator auditors unless a shorter time is required by applicable law.

10. Your Privacy Rights and Choices in Other States

Depending on where you are located, the nature of our business in that jurisdiction, and other factors, you may have the following rights:

  • Right to know / access / portability. The right to request that we confirm whether we are processing your personal information, obtain details about such processing, and obtain a copy of such personal information. 
  • Right to delete. The right to request that we delete your personal information.
  • Right to correct. The right to request that we correct your personal information.
  • Right to opt out of targeted advertising, selling, sharing for behavioral advertising, and certain profiling. The right to request an opt-out of certain processing activities including, as applicable, if we process your personal information for “targeted advertising” (as “targeted advertising” is defined by applicable privacy laws),  if we “sell” your personal information (as “sell” is defined by applicable privacy laws), if we “share” your personal information for “cross-context behavioral advertising”, or if we engage in “profiling” in furtherance of certain “decisions that produce legal or similarly significant effects” concerning you (as such terms are defined by applicable privacy laws).

We do not sell your data, but if you would like to opt out of the future sale or sharing of your data, please Click Here. We will process such requests in accordance with applicable laws. You have the right to be free from unlawful discrimination for exercising your rights under applicable law.

If you would like to opt out of the sharing of your data via cookies, including for cross-context advertising, please follow these steps: (a) clear your browser cookies, (b) revisit our site, and (c) select “Decline” in the cookie banner. When you select “Decline,” both 1) marketing and advertising cookies; and 2) any other non-essential analytics cookies, will be declined and only strictly necessary cookies required for the website to function will be placed.

Only you, or someone legally authorized to act on your behalf in certain jurisdictions, may make a request to exercise the rights listed above regarding your personal information. If your personal information is subject to a law that allows an authorized agent to act on your behalf in exercising your privacy rights and you wish to designate an authorized agent, please provide written authorization signed by you and your designated agent by emailing use below and asking us for additional instructions.

We will take steps to verify your identity before fulfilling requests submitted under applicable privacy laws. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative. Examples of our verification process may include asking you to confirm the email address we have associated with you.

Some laws may allow you to appeal our decision if we decline to process your request. If applicable laws grant you an appeal right, and you would like to appeal our decision with respect to your request, you may do so by informing us of this and providing us with information supporting your appeal.

Regardless of what privacy laws apply to your personal information, we may offer you the following choices:

  • Opt out of marketing emails. If you would like to stop receiving marketing emails, you can update your email preferences by clicking the “unsubscribe” button found at the bottom of the email. 
  • Opt out of marketing texts. If you would like to stop receiving marketing text messages, reply STOP to text messages. Text HELP for help. Message and data rates may apply.
  • Adjust push notification preferences. You may limit push notifications in our mobile apps by adjusting the permissions on your device.
  • Adjust location preferences. You can revoke our access to your device’s precise geolocation by adjusting your device settings.
  • Opt out of collection of precise geolocation from your device. You may at any time opt out from allowing us to access your device’s precise geolocation data by adjusting your device’s permissions.
  • Uninstall the mobile application. You can uninstall our mobile application at any time. You may use the standard uninstall process available as part of your mobile device or via the mobile application marketplace or network. If you uninstall the mobile application from your device, the unique identifier associated with your device will continue to be stored. If you re-install the application on the same device, we will be able to re-associate this identifier to your previous transactions and activities.
  • Delete your account on iPhone or Android devices. You may delete your account at any time from your mobile application. We will email you instructions to confirm your identity and finalize your deletion after you submit your account deletion request.


11. Updates to this Policy

We may update this privacy policy from time to time. The updated version will be indicated by an updated “Last updated” date below and the updated version will be effective as soon as it is accessible. If we make material changes to this privacy policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification.

If you do not agree to any updates to this Privacy Notice, please do not continue using or accessing the Services. We encourage you to review this privacy policy frequently to be informed of how we are protecting your information.
